I am sad that many "vendors" can behave in such selfish and uncaring manner to potential buyers. In fact it is difficult to call these people vendors at all. There are many property owners who pretend to put their properties up for sale. I have written about this before but it just goes on and on. They waste so many peoples time and money. Buyers often have come especially to Israel in order to buy real estate. Figures are agreed, sometimes even people of great communal influence use their leadership positions to help them in the negotiations, agents ( I know of many real estate agents who have seen this disgusting behavior) &amp;nbsp;work for hours in negotiations, the buyers are usually considerate and very fair, deals are allowed to go to lawyers when suddenly&amp;nbsp; the real truth of the vendor is seen. They are not seriously intending to sell, their words are worthless,&amp;nbsp; they act without caring about the many others involved. It hurts to see good people hurt by such disgraceful actions. I know that selling houses is no easy venture. Situations change, vendors change their minds and this happens. These are true vendors who mean to sell but during the process have good reason to halt the proceedings. These are not the people I am talking about. I would hope that anybody who decides to put his property up for sale, to do his homework and make sure that he really intends to sell. He should speak with his lawyers, his bank, check the market if he wishes to buy something else, check out the costs of taxes and moving and real estate broker fees etc. Vendors should also make sure that their family is united in their decision to sell. I have seen terrible arguments when spouses, children and parents get involved. All these matters have to be sorted out before putting the property on the market and wasting time and hurting others. I wish that their was a registration fee for vendors, so that if they were not serious, they would be fined.&amp;nbsp;These so called &amp;nbsp;"vendors" are giving Israel a bad name. If a vendor wants to know how much his property is worth all he has to do is ask a reliable real estate agent and that should be enough. He should not start bringing in buyers to see how big an offer he can get. In some cases&amp;nbsp;an offer is agreed between "vendor" and the buyer, these property owners&amp;nbsp;often allow lawyers to begin work just to show how "serious" they really are, or they suddenly jump their asking price even after accepting a particular&amp;nbsp;offer&amp;nbsp;verbally. This week even after the offer had been upped and agreed, the vendor once again continued with the same shaming behavior, allowing more hours of wasted energy by both buyers, lawyers and real estate agents. &lt;BR&gt;I would never pressure a client into buying or selling a property, I just expect fairness and honesty in negotiations, and a word should mean something once figures and conditions are agreed. &lt;BR&gt;It seems that many Israeli's are on another planet when dealing with buyer's from outside Israel. &lt;P class=MsoNormal style="TEXT-ALIGN: justify"&gt;A Real Estate transaction is often the largest transaction that a couple will make in the course of their life. Because of the complexity of the field of Real Estate in our country, it is natural that buyers and sellers choose to hire the services of an attorney to accompany the carrying out of the transaction. Recently a client turned to me to process a case against a lawyer who represented him in the sale of an apartment. The claim of the client was for negligence on the part of the lawyer because he had failed to check for the existence of an obligation for the payment of the property-improvement levy!&lt;/P&gt;
&lt;P class=MsoNormal style="TEXT-ALIGN: justify"&gt;What is the property-improvement levy?&lt;/P&gt;
&lt;P class=MsoNormal style="TEXT-ALIGN: justify"&gt;The property-improvement levy is a city tax for the right to additional construction or changes that improve the property. This property improvement is profit for the seller, since the value of the property increases with receipt of these rights, when they are actualized or when the property is sold; for example: a permit for additional construction or the construction of the building itself, receipt of a permit for the addition of a swimming pool to the house, a permit to enlarge the balconies or even to improve the public area around the building. All these can be a reason for the obligation to pay the property-improvement levy, and it must be stressed that there is no difference whether the rights to expansion have been actualized or not, rather it is enough that a city construction permit has been issued. From the details of the above one may understand that the obligation of the property-improvement levy may lead to the construction of an apartment house, and not just a single story house. One who purchases a property acquires all the rights or limitations on the property, and that is what sets the monetary value of the property. A seller, who presents his apartment without knowing about the taxes obligatory on the property and the construction rights, is likely to end up selling at a loss. In the case above, the sellers discovered that they had to pay 50,000 New Shekels for the construction rights on the roof of the building, which had not yet been actualized.&lt;/P&gt;
&lt;P class=MsoNormal style="TEXT-ALIGN: justify"&gt;The accepted practice with property contracts is that the owners have the responsibility for the property-improvement levy up until the signing of the contract, since the owner knows whether or not requests for structural changes to the building have been submitted. The lawyer had not checked the tax obligations, and it was only discovered after the signing. As a result the buyer gained the construction rights, and the seller, who wasn’t aware of the expansion rights, sold his apartment at a lower price than what it was worth on the market. A lawyer who is knowledgeable in the field of Real Estate constitutes a guarantee to lowering of the dangers and the unnecessary expenses that sometimes can amount to hundreds of thousands of New Shekels. This guarantee has gained importance and a renewed validity in light of the fact that 80% of the litigation for negligence is against lawyers in the Real Estate field.&lt;/P&gt;

Many vendors are putting their real estate on the market to sell and &amp;nbsp;allowing agents and many other sides&amp;nbsp;to work for hours and hours&amp;nbsp;in difficult negotiations, only to say at a very late stage, many times the deal is already with lawyers that they are not prepared to sell. This is giving Israel a very bad name with regards to the real estate market. If a vendor decides to put his home up for sale it is vital that he does his homework first. He must decide if he actually wants to seriously sell, not just to test the market.&amp;nbsp;Choosing the&amp;nbsp;currency is also vital. If the owner wants security, then ask in Shekels. If the vendor asks in Dollars he must understand that the Dollar can plummet or suddenly go high. If the Dollar currency is chosen it should be made clear if he wants to be paid in Dollars or in Israeli Shekels and at a particular exchange rate. Vendors must realize that many people are involved including&amp;nbsp; buyers and their families, bankers, lawyers and brokers once they put their property on the market and claim that they want to sell. Many buyers&amp;nbsp;are new immigrants or investors visiting Israel in order to buy. In my opinion the vendors who are not serious do not realize or care about the time wasting to others and the serious damage that they can do. Perhaps there should be a law that fines vendors for putting properties on the market if they decide not to sell. This is a worry for many vendors in Israel. Israeli property vendors will either turn to a Shekel asking price or demand a bottom line Dollar exchange rate so as not to lose too much money. Many vendors sell in Dollars and if they are buying new properties they&amp;nbsp;have to&amp;nbsp;pay in Shekels. This can cause many problems and many deals have been broken before contract due to the Dollar Shekel exchange rate issue. I understand the problems of foreign buyers, especially those who have US Dollars and want to pay in Dollar currency. It must be understood that Israel is a country whose currency is Shekels, it would be ludicrous if I wanted to buy real estate in the USA and expected the vendors to except Israel Shekels. For many years the Dollar has stood strong and both Israeli's and foreign buyers have enjoyed using the Dollar as the currency for real estate transactions. Now things are changing.
